C\u0103n c\u1ee9 ph\u00e1t sinh tr\u00e1ch nhi\u1ec7m b\u1ed3i th\u01b0\u1eddng thi\u1ec7t h\u1ea1i<\/span><\/strong><\/h3>\n<p style=\"text-align: justify;\">Theo quy \u0111\u1ecbnh t\u1ea1i \u0110i\u1ec1u 584 B\u1ed9 Lu\u1eadt d\u00e2n s\u1ef1 2015 (BLDS 2015), ng\u01b0\u1eddi n\u00e0o c\u00f3 h\u00e0nh vi x\u00e2m ph\u1ea1m t\u00ednh m\u1ea1ng, s\u1ee9c kh\u1ecfe, danh d\u1ef1, nh\u00e2n ph\u1ea9m, uy t\u00edn, t\u00e0i s\u1ea3n, quy\u1ec1n, l\u1ee3i \u00edch h\u1ee3p ph\u00e1p kh\u00e1c c\u1ee7a ng\u01b0\u1eddi kh\u00e1c m\u00e0 g\u00e2y thi\u1ec7t h\u1ea1i <strong>th\u00ec ph\u1ea3i b\u1ed3i th\u01b0\u1eddng<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><strong>C\u0103n c\u1ee9 ph\u00e1t sinh tr\u00e1ch nhi\u1ec7m b\u1ed3i th\u01b0\u1eddng thi\u1ec7t h\u1ea1i g\u1ed3m:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li><span id=\"Co_thiet_hai_xay_ra\">C\u00f3 thi\u1ec7t h\u1ea1i x\u1ea3y ra<\/span><\/li>\n<li><span id=\"Co_hanh_vi_trai_phap_luat\">C\u00f3 h\u00e0nh vi tr\u00e1i ph\u00e1p lu\u1eadt<\/span><\/li>\n<li><span id=\"Moi_quan_he_nhan_qua_giua_thiet_hai_xay_ra_va_hanh_vi_trai_phap_luat\">M\u1ed1i quan h\u1ec7 nh\u00e2n qu\u1ea3 gi\u1eefa thi\u1ec7t h\u1ea1i x\u1ea3y ra v\u00e0 h\u00e0nh vi tr\u00e1i ph\u00e1p lu\u1eadt<\/span><\/li>\n<li><span id=\"Yeu_to_loi_trong_trach_nhiem_dan_su\">Y\u1ebfu t\u1ed1 l\u1ed7i trong tr\u00e1ch nhi\u1ec7m d\u00e2n s\u1ef1<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><strong><span id=\"Nguyen_tac_boi_thuong_thiet_hai\">2. Nguy\u00ean t\u1eafc b\u1ed3i th\u01b0\u1eddng thi\u1ec7t h\u1ea1i<\/span><\/strong><\/h3>\n<p style=\"text-align: justify;\">Nguy\u00ean t\u1eafc b\u1ed3i th\u01b0\u1eddng thi\u1ec7t h\u1ea1i \u0111\u01b0\u1ee3c quy \u0111\u1ecbnh t\u1ea1i \u0110i\u1ec1u 585 BLDS 2015:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Thi\u1ec7t h\u1ea1i th\u1ef1c t\u1ebf ph\u1ea3i \u0111\u01b0\u1ee3c b\u1ed3i th\u01b0\u1eddng to\u00e0n b\u1ed9 v\u00e0 k\u1ecbp th\u1eddi.<\/li>\n<li>Ng\u01b0\u1eddi ch\u1ecbu tr\u00e1ch nhi\u1ec7m b\u1ed3i th\u01b0\u1eddng thi\u1ec7t h\u1ea1i c\u00f3 th\u1ec3 \u0111\u01b0\u1ee3c gi\u1ea3m m\u1ee9c b\u1ed3i th\u01b0\u1eddng n\u1ebfu kh\u00f4ng c\u00f3 l\u1ed7i ho\u1eb7c c\u00f3 l\u1ed7i v\u00f4 \u00fd v\u00e0 thi\u1ec7t h\u1ea1i qu\u00e1 l\u1edbn so v\u1edbi kh\u1ea3 n\u0103ng kinh t\u1ebf c\u1ee7a m\u00ecnh.<\/li>\n<li>Khi m\u1ee9c b\u1ed3i th\u01b0\u1eddng kh\u00f4ng c\u00f2n ph\u00f9 h\u1ee3p v\u1edbi th\u1ef1c t\u1ebf th\u00ec b\u00ean b\u1ecb thi\u1ec7t h\u1ea1i ho\u1eb7c b\u00ean g\u00e2y thi\u1ec7t h\u1ea1i c\u00f3 quy\u1ec1n y\u00eau c\u1ea7u T\u00f2a \u00e1n ho\u1eb7c c\u01a1 quan nh\u00e0 n\u01b0\u1edbc c\u00f3 th\u1ea9m quy\u1ec1n kh\u00e1c thay \u0111\u1ed5i m\u1ee9c b\u1ed3i th\u01b0\u1eddng.<\/li>\n<li>Khi b\u00ean b\u1ecb thi\u1ec7t h\u1ea1i c\u00f3 l\u1ed7i trong vi\u1ec7c g\u00e2y thi\u1ec7t h\u1ea1i th\u00ec kh\u00f4ng \u0111\u01b0\u1ee3c b\u1ed3i th\u01b0\u1eddng ph\u1ea7n thi\u1ec7t h\u1ea1i do l\u1ed7i c\u1ee7a m\u00ecnh g\u00e2y ra.<\/li>\n<li>B\u00ean c\u00f3 quy\u1ec1n, l\u1ee3i \u00edch b\u1ecb x\u00e2m ph\u1ea1m kh\u00f4ng \u0111\u01b0\u1ee3c b\u1ed3i th\u01b0\u1eddng n\u1ebfu thi\u1ec7t h\u1ea1i x\u1ea3y ra do kh\u00f4ng \u00e1p d\u1ee5ng c\u00e1c bi\u1ec7n ph\u00e1p c\u1ea7n thi\u1ebft, h\u1ee3p l\u00fd \u0111\u1ec3 ng\u0103n ch\u1eb7n, h\u1ea1n ch\u1ebf thi\u1ec7t h\u1ea1i cho ch\u00ednh m\u00ecnh.<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><strong><span id=\"Lam_the_nao_khi_gay_thiet_hai_ma_khong_du_kha_nang_boi_thuong\">3.
